Case Overview

After a trial court found that Louisiana State University’s expulsion of two dental students violated their constitutional due process rights, the university sought — and was granted — a “suspensive appeal” that would delay the trial court’s order that the students be reinstated until after the university had exhausted its appeals. FIRE argued that if universities can exclude students whose expulsions were unconstitutional throughout years of appeals, universities will be empowered to violate students’ rights with impunity.
