On November 29, 2022, Bluefield State University President Robin Capehart published a blog post calling faculty members who cast a vote of no confidence in his leadership “entitled,” “miserable,” “ungrateful,” and “lost souls,” and threatened to retaliate against them. FIRE wrote Bluefield State on March 1, 2023, explaining that the First Amendment, which binds the public university, prevents administrators from retaliating against faculty for their protected expression, including for criticism of the university and its administrators.
