Green light: Student Handbook: General Definitions and Conditions of Misconduct- Harassment 12-13

The University defines harassment as conduct that is so severe, pervasive, and objectively offensive that
it so undermines and detracts from a student’s educational experience or creates a hostile environment
and essentially denies a student equal access to the University’s resources and opportunities. Conduct
over social media that rises to this level is prohibited. Harassment, as defined above, is not protected by
the First Amendment.

Green light: Student Handbook: Anti-Discrimination Policy 12-13

Sexual
harassment is defined as unwelcome sexual advances, requests for sexual favors,
and other unwelcome verbal and physical conduct based on sex when: ... Such conduct has the purpose or effect of substantially and unreasonably
interfering with an individual's work or academic performance or creating an
intimidating, hostile or offensive working or educational environment. For
such conduct to constitute sexual harassment in the teaching context, the
behavior must also be persistent, pervasive, and not germane to the
academic subject matter and affect a student’s class participation, or ability
to participate in or benefit from an education program, opportunity or activity,
or create an intimidating, threatening or abusive educational environment.

Internet Usage Policies

Yellow light: Student Handbook: Computer and Data Networks- Acceptable Use Policy 12-13

Free expression of ideas is central to the academic process. Western State
College computer system administrators will not remove any information from
individual accounts, servers or electronic bulletin boards maintained in individual
accounts unless it is determined that: ... The information is inappropriate, because it is unrelated to or is
inconsistent with the mission of the College, or is otherwise not in
compliance with the legal and ethical usage responsibilities outlined in
Federal, State, and college policies.

Green light: Student Handbook: Inappropriate Behavior 12-13

Behavior which infringes on the rights of others or interferes with the normal functioning of the
University will result in disciplinary action through established procedures of the University. Any threats of
harm or harassment in social media may be subject to discussions and can be considered as evidence in
the judicial process as well as subject to a judicial hearing.
