Dear Vanderbilt Students,
The University has revised its sexual misconduct policy in light of guidance provided by the U.S. Department of Education's Office of Civil Rights, regarding the specific Title IX requirements applicable to sexual misconduct. The department outlines that "sexual harassment of students, which includes acts of sexual violence, is a form of sexdiscrimination prohibited by Title IX."
Under the revised policy, the Office of Equal Opportunity, Affirmative Action, and Disabilities Services (EAD) will now investigate all complaints and render decisions in all cases pertaining to alleged sexual misconduct, which includessexual harassment and sexual violence. EAD reports to Anita Jenious, who serves as Vanderbilt's Title IX coordinator.
The Office of Student Conduct and Academic Integrity will determine the sanctions for those students who EAD determines have violated the University's policy. Under the revised policy, both parties to a sexual misconduct case have an opportunity to appeal the finding or sanction.
A key component of the revised policy highlights the difference between privacy and confidentiality in the filing of complaints. Students who wish to discuss an incident confidentially may speak to mental health professionals at the Psychological and Counseling Center, health practitioners at the Student Health Center or members of the clergy acting in their official capacity. Otherwise, all information reported to other employees of the University is kept private to the extent possible and only disclosed to those with a need or right to know.
Students are also encouraged to call the Vanderbilt University Police Department or the Metropolitan Nashville Police Department to file a complaint. The filing of a police report or pending civil or criminal proceedings does not preclude EAD from proceeding with an investigation and determination.
Campus resources for students with concerns about sexual misconduct include Project Safe, the Margaret Cunningham Women's Center, the K.C. Potter Center, the Psychological and Counseling Center, the Student Health Center, The Office of Religious Life, and the Victim Services Coordinator at the Vanderbilt University Police Department.
